Terms of Service
These terms govern your use of Mentalist — the website at trymentalist.com, the application, and everything the agent does on your behalf. By creating an account or using the service you agree to them.

The agreement
This is an agreement between Mentalist (“Mentalist”, “we”) and you. If you accept these terms on behalf of a company, you confirm you are authorised to bind it, and “you” means that company. You must be at least 18 and legally able to enter a contract.
Our Privacy Policy is part of this agreement.
The service
Mentalist is an AI prospecting agent. It researches your market, builds and enriches lists of potential buyers, watches for buying signals, and drafts and sends outreach from accounts you connect. You decide who is contacted and what the agent knows; the agent handles the work.
Mentalist is not a lead-list vendor, a data broker, or a compliance service. We do not warrant that any contact detail is accurate or current, that any message will be delivered, or that outreach will produce results.
Accounts & workspaces
Sign-in requires a Google Workspace account. Keep your credentials secure — you are responsible for everything done under your account.
Your data lives in an organisation (workspace). Anyone you invite can see and act on that workspace’s data, including its leads, campaigns and message history. Invite only people who should have that access, and remove them when they leave. If your workspace belongs to your employer, your employer controls it and may access, export or delete its data.
Credits, plans & billing
- Credits meter usage. One credit is consumed per outbound action — for example one outreach message sent. Sourcing and enriching leads is free and never credit-capped.
- Free includes 500 credits per month. Paid includes 5,000 credits per month for $150 per month.
- Monthly credits refill and do not roll over: whatever is unused at the end of a billing period is lost. Referral and bonus credits sit in a separate bucket and persist.
- At zero credits, outbound actions are blocked until your plan refills or you upgrade. Nothing is silently charged beyond your plan.
Paid subscriptions are billed in advance through Stripe and renew automatically each month until cancelled. Prices are exclusive of VAT and other taxes, which we add where required. Cancel at any time from Manage billing in Settings; cancellation takes effect at the end of the current period and you keep access until then. Except where law requires otherwise, fees are non-refundable and unused credits have no cash value. If a payment fails we may suspend paid features until it clears. We may change prices with at least 30 days’ notice, effective at your next renewal.
Referrals & bonus credits
We may grant bonus credits — for example for referring a new organisation. Bonus credits are promotional, have no cash value, are not transferable, and cannot be exchanged or refunded. We may withhold or revoke them, and close the accounts involved, where we detect abuse such as self-referral, fake or duplicate signups, or automated enrolment.
Connected accounts
To send on your behalf, Mentalist needs you to connect a mailbox (Google) and, optionally, a LinkedIn account (through our provider Unipile). By connecting an account you authorise us to take the actions described at consent time — send messages, read the threads your outreach starts, and manage related calendar events — for as long as the connection is active.
You must own or be authorised to use each account you connect, and your use of it must comply with that provider’s own terms. Disconnect at any time in Settings, or revoke Google access at myaccount.google.com/permissions. Revoking stops sending immediately.
Acceptable use
You agree not to use Mentalist to:
- Send unlawful, deceptive, harassing, defamatory, hateful or sexually explicit messages, or impersonate anyone.
- Promote fraud, scams, malware, phishing, illegal products, or investment or crypto solicitations you are not licensed to make.
- Target individuals in their personal capacity, or knowingly contact minors.
- Circumvent credit limits, resell or white-label the service, or share access with people outside your organisation.
- Reverse-engineer, scrape, load-test or overload the service, probe its security, or bypass rate limits and authentication.
- Upload data you have no right to use, including data obtained in breach of another provider's terms or of a confidentiality obligation.
Outbound compliance
You are the sender. Messages go out from your mailbox and your LinkedIn account, under your name, to people you chose — which makes you the data controller and the party responsible for the outreach.
- You must comply with the law that applies to your sending, including CAN-SPAM, CASL, the GDPR and the ePrivacy rules, and equivalent local regimes: accurate sender identity and subject lines, a working opt-out, and a lawful basis for contacting each person.
- You must honour unsubscribe and objection requests promptly, and not re-contact someone who has opted out.
- You must not use the agent to send at volumes or in ways that would breach your email or LinkedIn provider's limits or policies.
- You are responsible for the content of every message, including any AI-drafted message you allow to be sent.
We may throttle, block or remove outreach that we reasonably believe breaches this section, and we may act on abuse complaints we receive about your sending.
AI output
The agent’s research, targeting decisions and drafted messages are generated automatically by large language models. They can be incomplete, outdated or plainly wrong, and they may attribute facts to a company or person incorrectly. Output is a suggestion, not advice, and it is not legal, financial or professional advice.
Review outreach before it goes out, and check anything that matters. You are responsible for what your workspace sends, and you accept that similar output may be generated for other customers.
Your data & content
Your content — your company and ICP knowledge, your lists, your campaigns, your messages — remains yours. You grant us a worldwide, non-exclusive, royalty-free licence to host, process and transmit it solely to operate and support the service, including sending it to the providers listed in our Privacy Policy for that purpose.
You warrant that you have the rights and the lawful basis needed for the personal data you put into, or instruct the agent to collect for, your workspace. Where we process that personal data on your behalf we do so as your processor, on your instructions.
You can export or delete your workspace data at any time, and we will delete it on request as described in the Privacy Policy. If you send us feedback or ideas, we may use them freely without obligation to you.
Intellectual property
Mentalist, its software, models, prompts, design and brand are ours or our licensors’. These terms grant you a limited, revocable, non-transferable right to use the service while your account is in good standing — and nothing more. You may not remove or obscure our notices, or use our name or marks without permission.
Availability & changes
The service is provided without an uptime commitment. We may change, add or remove features, and we may schedule maintenance. For changes that materially reduce the functionality of a paid plan we will give reasonable notice; if you do not accept such a change you may cancel and receive a pro-rata refund of the unused part of your current period.
We may update these terms. If a change is material we will notify account owners by email or in-product before it takes effect, and continued use after that date means you accept it.
Suspension & termination
You may stop using the service and delete your account at any time. We may suspend or terminate access — with notice where practicable, and immediately where the risk requires it — if you breach these terms, fail to pay, or if your use exposes us or a provider to legal, security or deliverability risk. On termination your right to use the service ends and we delete or anonymise your data as described in the Privacy Policy. Sections that should survive termination do.
Disclaimers
To the fullest extent permitted by law, the service is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including merchantability, fitness for a particular purpose, non-infringement, accuracy of data, uninterrupted operation, or that outreach will be delivered, seen, or answered. Nothing here excludes rights you have under mandatory consumer law.
Limitation of liability
To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost pipeline, lost data or goodwill, even if warned they were possible.
Our total aggregate liability arising out of or relating to the service is capped at the greater of (a) the fees you paid us in the twelve months before the event giving rise to the claim, or (b) one hundred euros (€100). Neither party’s liability is limited for death or personal injury caused by negligence, fraud, or anything else that cannot be limited by law.
Indemnity
You will defend and indemnify Mentalistagainst claims, damages, fines and reasonable costs arising from your use of the service in breach of these terms — in particular from your outreach, the personal data you process through the service, or a platform’s action against an account you connected.
Governing law & disputes
These terms are governed by the laws of France, without regard to conflict-of-law rules, and the parties submit to the exclusive jurisdiction of the competent courts of Paris, France. If you are a consumer, you keep the protection of the mandatory law of your country of residence.
Talk to us first: email us and we will try to resolve the matter informally before either side starts proceedings. If a provision is held unenforceable, the rest stays in force. Neither party’s failure to enforce a right waives it. You may not assign this agreement without our consent; we may assign it in connection with a merger or sale of assets.
